1. Introduction and Legal Notices
These terms govern sales made on the site www.https://faitsdarmes.com/en/ between:

And on the other hand, any individual or legal entity making a purchase on the site, hereinafter referred to as "the Client".
2. Acceptance of Terms
Any order placed on the site www.https://faitsdarmes.com/en/ implies full, complete, and unconditional acceptance by the Client of these General Terms and Conditions of Sale (GTC). The Client declares having read these GTC before validating their order. The validation of the order constitutes acceptance of the GTC.
3. Products and Safety Warning
3.1 Characteristics The products offered for sale (plastic, foam, secure steel sword simulators, protective equipment) are described as accurately as possible. The offers are valid as long as they are visible on the site and within the limits of available stocks.
3.2 Nature of Products and Usage Precautions The Client is informed that the products sold by FAITS D'ARMES are sports equipment intended for the practice of Historical European Martial Arts (HEMA) or theatrical fencing. Although these simulators are not considered category D weapons subject to declaration (unless explicitly stated otherwise on the product sheet), their use may present risks of injury.
3.3 Responsibility and Safety The purchase and use of the products are carried out under the sole responsibility of the Client. It is the Client's responsibility to:

Train in appropriate combat techniques.

Wear adequate body protection when using the simulators.

Not modify the products or use them for purposes other than those intended. FAITS D'ARMES cannot be held responsible for bodily or material damage resulting from misuse, negligence, or lack of protection by the practitioner.
3.4 Sale to Minors Although the products are freely available for sale, for safety and ethical reasons, the Client declares to be of legal age or to have parental authorization to make purchases on the site.
4. Price and Payment
4.1 Price Prices are indicated in euros, including all taxes (VAT included), excluding delivery charges. FAITS D'ARMES reserves the right to modify its prices at any time, but the product will be billed based on the rate in effect at the time of order validation.
4.2 Payment Methods Payment is due immediately upon ordering. The Client can pay for their purchases by:

Bank Transfer (The order will be shipped after the funds are received in the company's account).
Payment by check is not accepted. In case of non-payment, the order will be automatically canceled.
5. Delivery
5.1 Timeframes and Methods Products are delivered to the address indicated at the time of order. The indicative delivery time is specified upon validation. In the absence of indication or delivery on time, and in accordance with the Consumer Code, delivery will occur no later than 30 days after the order. The risks of loss or damage to the products are transferred to the Client when they physically take possession of the goods.
5.2 International Shipments For any order shipped outside mainland France, the Client is the importer of the product concerned. Customs duties, local taxes, or import duties may be required. These duties are not the responsibility of FAITS D'ARMES and remain the responsibility and under the full responsibility of the Client (declarations and payments to the competent authorities).
6. Right of Withdrawal
6.1 Timeframe and Methods In accordance with legal provisions (Article L221-18 of the Consumer Code), the Client has a period of 14 days from the receipt of the products to exercise their right of withdrawal without having to justify reasons or pay penalties.
6.2 Return of Products The Client must return the goods no later than 14 days after communicating their decision to withdraw. Products must be returned in their original condition, complete (packaging, accessories, instructions) and in perfect resale condition to the following address:

Return costs are the responsibility of the Client. The Client's responsibility may be engaged in case of depreciation of the goods resulting from handling other than that necessary to establish the nature and proper functioning of these goods.
6.3 Refund In the case of a valid withdrawal, FAITS D'ARMES will refund all sums paid, including delivery costs (based on the standard rate), within 14 days following the recovery of the goods or proof of their shipment.
7. Legal Guarantees
Independently of any commercial guarantee that may be offered, FAITS D'ARMES remains liable for defects in conformity of the goods and hidden defects under the conditions provided for in Articles L. 217-3 and following of the Consumer Code and 1641 and following of the Civil Code.

Legal guarantee of conformity (2 years): The Client has a period of two years from the delivery of the goods to act. They can choose between repairing or replacing the goods, subject to the cost conditions provided for in Article L. 217-12 of the Consumer Code. The Client is exempt from proving the existence of the lack of conformity during the 24 months following the delivery of the goods.

Guarantee against hidden defects: The Client can decide to implement the guarantee against hidden defects of the sold item. In this case, they can choose between the cancellation of the sale or a reduction in the sale price.
8. Personal Data (GDPR)
In the context of order management, FAITS D'ARMES collects personal data concerning the Client (name, address, email, phone).
8.1 Purpose and Legal Basis This data is necessary for the execution of the sales contract (order processing, billing, delivery). They are only transmitted to the service providers essential for this execution (carriers, payment solutions).
8.2 Client Rights In accordance with the General Data Protection Regulation (GDPR), the Client has the right to access, rectify, delete, and port their data. To exercise these rights, the Client can contact FAITS D'ARMES by email or by mail at the company's headquarters address.
8.3 Opposition to Solicitation (Bloctel) If the Client's phone number is collected, they are informed of their right to register for free on the "Bloctel" telephone solicitation opposition list (www.bloctel.gouv.fr).
9. Disputes and Applicable Law
These conditions are subject to French law. In case of a dispute, the Client will first contact FAITS D'ARMES to obtain an amicable solution. Failing that, French courts will have sole jurisdiction.
